2:27

anyone wishing to speak in opposition

2:33

okay I’m going to close this down and bring it back to the board for a motion

2:40

chairman mm-hmm is this what is this in the future is

2:45

this what he’s done I know they’ve done some Renovations there

2:51

do we know them this is a new proposal

3:00

it must be an expansion if you look at the haven’t been in a while the last time I

3:05

was able was for the parade but so there’s no issues with the building department everything’s going through

3:13

I I mean I could certainly verify with the Building Commissioner but typically this does not get in front of the select

3:20

board without all fired and inspectional services sign on

3:25

so so we forgot that found good well I have no problem he’s a good operator you know that’s good to see him

3:33

expanding I said well I have no problem with this

3:39

little emotion I’ll make a motion that we approve I’ll second that motion motion by Mr Canty

3:46

second by Mr Blitzer all those in favor Mr bletzer aye Mr helm

3:53

yes Mr Canty yes Mr Mahoney yes and I’ll one

3:59

abstention myself

4:05

in accordance with well okay I’ll just check that off it’s another alteration of premises and

4:11

this is for the Cabby Shack in accordance with chapter 138 of the Massachusetts general laws as amended

4:18

notices hereby given that a public hearing will be held at Plymouth Town Hall 26 Court Street on Tuesday June 13

4:26

2023 at 602 pm to consider the application for an alteration of

4:31

premises from Cabby Shack Incorporated doing business as Cabby Shack Town off

4:37

hold of annual all alcohol restaurant license Clyde abrinia’s manager

4:43

description of the premises is as follows single-story wood frame building

4:48

fronting on Tom Offroad two side entrances four rear entrances entrances

4:55

outdoor deck eating and Patio area adjoining existing license premises on

5:01

the east side of the property open air roof deck with will be used for service

5:07

of food and beverages applicants seeks to add additional outdoor seating in the

5:12

gordoned off parking lot basically he wants to add the the seating in in the

5:18

parking area of like he did during Colvin there’s a tent there and I did do

5:24

a walk about the site on Sunday I just to be a little familiar with it and so

5:30

that’s what I saw is there anyone here on cabby shark’s

5:35

behalf would you like to say a few words or Okay so

5:42

all right so it’s pretty vanilla that’s what he wants to do so he also is in the executive session

5:49

later on uh Felice all right I can speak to

5:56

you so yeah I also went down and uh and we toured the premises and

6:03

and what he’s doing he he’s trying to uh beautify that area he’s been doing it

6:09

for the last few years but before he spends money he wants to get you know the okay he went to the zoning

6:16

the Planning and Zoning both to prove that and he had to pay into the pack and

6:21

fund which he did and it looks it’s going to look a lot better than it looked last year but he’s got plans to

6:28

to Really Spruce it up if we give him the okay and and I’d like to see that down there you know and he’s smarty you

6:35

know until he gets the okay you know it’s tough to uh it’s tough to spend a lot of money down

6:42

there if it’s not going to be a permanent thing so again I believe he’s a good operator

6:47

he’s good for the Waterfront and so I and I like what I saw uh uh Sunday

6:54

I like what I saw so uh I’m all for this for this just like Dylan’s on for this

7:00

proposal

7:07

any questions from board members or comments from anyone else

7:13

bowling John so I this proposal he had this public Hearing

7:20

in the executive session they’re intertwined correct they will be yeah so if we do uh someone one of the members

7:28

makes the motion I’m hoping that it’s contingent upon the lease sure yes absolutely Mr chairman thank you so I

7:36

can make I if anybody is and have a car I can make that motion right now that we we okay this and uh I know the season

7:45

has started so I know it’s uh they know they want to get this thing uh

7:50

wrapped up so they can start operating because I mean it’s just starting to get real busy down there so I’ll make the

7:56

motion that we approve this outside and then continue on WE with the least the

8:03

lease extension or whatever we’re going to do with the lease so

8:08

I’ll second that motion okay motion by Mr bletzer second by Mr

8:14

Helm discussion all those in favor Mr Mahoney yes

8:20

Mr Canty yes Mr Helm yes Mr blood sir yes myself yes

8:26

unanimous and for the record I do not sell Cabby Shack vegetables

8:31

thank you okay thank you for coming

8:40

all right moving on to the next public hearing uh it’s a pouring permit dirty water

8:47

Distillery in accordance with chapter 138 of the Massachusetts general laws as amended

8:54

notices hereby given that a public can will be held at Plymouth Town Hall 26 Court Street on Tuesday June 13 2023 at

9:03

603 pm to consider the application for an alteration of premises for a 19-h

9:10

pouring permit for a distiller dirty water Distillery LLC 49 Cottage Park

9:16

Circle Bay 2 holder of a farmer Distillery pouring permit Petrus

9:24

as owners Jr PhD manager description of premises is as follows single level 4

9:32

500 square foot light manufacturing space approximately three thousand

9:38

square feet set aside and separated for production and 1500 square feet Public

9:44

Access Tasting Room restrooms access Etc

9:49

update sprinkle the system 2023 with masonry firewalls separating adjacent

9:55

tenants two entrances and exits applicants seeks to add 19 H Poorman

10:02

permit to Allied to allow combined use of dirty water Distillery Tap Room to be

10:08

used to serve beer brewed by the dirty water Distillery dueling business as the

10:14

AMA Nama in addition to serving their distilled Goods so it’s pretty self-explanatory but I

10:21

believe this is our first commitment it’s an actual Distillery and a place where you can consume correct and

10:30

always was it the states well I know this Distillery was the one on Water Street Water Street and now they’re

10:36

moving to Cottage I believe I thought you could consume on Water Street but I could be wrong

10:43

yeah you want to come up here please say something or you want to just

10:56

that’s why we were on Water Street for a little more than 10 years

11:01

um and about five years ago we got a pouring permit for The Distillery we had also started a small Brewery

11:10

operation separately and we had to have physically separated tap rooms because they weren’t owned by

11:17

the same LLC okay so in moving to cordage park moved ownership of the

11:24

brewery to The Distillery so they’re both owned by the same entity which is the requirement for the 19h so that you

11:31

could share a tap room so you can come down to cordage park and have a hard

11:36

Seltzer cocktail or a beer okay because I knew this was a new

11:42

application for the I think it was for the state at this time yeah it took a little longer for you and that’s why

11:48

almost a year yeah that’s why I brought it up because I knew and could you just identify yourself for the record so

11:54

patras appizonas Jr the manager and owner and

12:07

to just out of curiosity did you leave Water Street voluntarily and what is

12:12

going in the space that you’re vacating um you don’t have to answer no no

12:17

um Water Street the property was owned by Al Eddie um who is the guy who runs habilitation

12:23

the access Vans um and he owned that property together

12:28

with his father-in-law and some other Old-Timers that wanted out so they sold

12:34

the the property 10 Water Street and I think it’s

12:40

either 11 or 9 that you know the space across the street um to a developer and I can’t remember

12:46

his name but he didn’t he wanted us to stay

12:51

but he didn’t want to make any improvements or fixes until we signed another lease um

12:58

I just we kind of came to an impasse and decided that A Change Is changes for the

13:05

better so that’s you know so now we’re in corded Park we’re next door to 1620.

13:11

parking is no longer an issue all right thank you

13:18

any other questions from the board at this time I’d like to open it up is

13:23

anybody wishing to speak in favor of this application anyone wishing to speak in opposition

13:32

seeing Nano close to him and bring it back to the board for a motion

13:37

moved by Mr Mahoney second by Mr bletzer all those in favor Mr bletza yes Mr Helm

13:44

yes Mr Canty yes Mr Mahoney yes and myself yes good luck

13:52

and thank you okay we’ve got additional licenses the

13:58

Holy Ghost Mayflower Brewing Company veteran services fresh squeezed craft and scoop and ice

14:05

cream dirty water Distillery then we have a few permits Holy Ghost

14:12

society and history administrative notes any notes or concerns with anything I’ve

14:18

mentioned if not we can move them all

14:25

motion to move as a group second

14:31

just discussion motion by Mr bless excuse me second by Mr Canty

14:37

discussion follows in favor Mr bletzer yes Mr Helm yes Mr Canty yes Mr Mahoney and myself

14:46

yes unanimous moving on to select board open discussion new business

14:55

Mr Helm I would just like to make a comment um

15:01

I think that didn’t we I thought we did administrative notes

15:06

didn’t we just move this yeah we did yeah that was part of the group

15:20

um I didn’t really have been doing that so I’d like to uh let’s talk about number two

15:27

again okay so all right hold on a second oh I see what you’re saying number two okay I

15:34

I did mention it but to reconsider this sorry we can make let’s let’s do our new business stuff

15:41

all right and then we’ll go all right go ahead Mr Helm no problem uh yeah I would

15:46

just you know I mean it’s just an observation um and I don’t know how the board wants to deal with this moving forward but I

15:54

do think that if we have a public hearing and I’m not talking about licenses an administrative note it’s

16:01

it’s kind of disturbing to me I don’t know about anybody else that this is

16:06

like the second week in a row we have had people who who are involved business

16:12

involved in a public hearing who do not come to the public hearing

16:19

and yet we vote to allow whatever they’re asking for with no ability to

16:26

ask any questions or or anything and and I think that I think

16:34

that in my mind I I think we should make a policy and it’s up to the chair and

16:39

whoever else that if you do not come to your public hearing then it is deferred

16:45

until the next meeting or a time when you do decide to come to the public hearing

16:51

just that’s just how I feel well we had three and we had two people yes really

16:57

just the one that did it yeah yeah just one but but um last week I believe was it Ocho Ocho

17:05

Cafe did not come to to theirs um which you know

17:10

um um okay so that’s just I mean and it’s would you be okay if they were available by

17:16

um Zoom oh absolutely absolutely that’s fine but to just not show up kind of

17:25

seems to me that getting something at a public hearing done by the board would be

17:32

integral to the success of your business and to just kind of not come I think has

17:37

um there should be ramifications let me put it that way okay

17:43

you know Harry I 100 agree with what you’re saying and I voted on uh Dillons

17:49

just because I’m familiar with the operation and uh that’s why I was comfortable but you’re right and when

17:54

it’s in operation we don’t know about uh you know there’s we may have some

18:00

questions in fact uh I might have had you I I would like to

18:06

be able to last week I had some questions last week but I still voted and I shouldn’t have so I agree can we

18:12

uh can we make that a policy uh Derek Lisa yeah with the Pledge on the board

18:18

if you if you’d like we can notify all the applicants that they must be present at the night of the hearing I have a

18:24

representative present yeah it’s been happening a lot lately and it

18:30

I don’t think it was always like that so John you can probably uh confirm that do you agree the board

18:37

agrees that we should they should somebody should be present so I’ll make a motion right now that when folks are

18:45

coming before us for license uh permits uh

18:53

alteration of premises what uh anything that requires a public

18:58

hearing I I wouldn’t say that I don’t think we need a motion but we understand the

19:03

intention of the board I prefer we stay away from motions in the new business yes but I’m happy to um to relay the

19:11

information like clearly okay everyone’s not in their head and we can make that a policy sure okay thank you

19:18

okay anything else on a new business letters

19:25

new business okay I’d like to try the request for the town

19:32

manager uh is there any way is there any app funds available uh I I walk the sidewalks in downtown

19:40

Plymouth and you know I see I’m seeing a lot of trash in businesses

19:46

and and I’m seeing uh the sidewalks

19:51

could be cleaner is there any way we can get if you could look into uh requiring

19:58

a machine that could go up and down the sidewalks early in the morning and clean those sidewalks and then maybe we can

20:05

talk to the the the business owners about making sure if they have to put trash in

20:11

the front you know put it somewhere where you know the tourists the residents don’t have to walk by walk by

20:17

Sunday and I saw trash I’m not going to mention the businesses but it’s there all the time and also

20:23

you know I used to run a place on Main Street and we always at the end of the night we swept out front in the morning it was

20:31

the either the cleaner or the gay bartender swept the front uh if you have

20:36

access to a hose hose it you know keep it clean we we got to work together but I think we could really uh set an

20:44

example if we if we could acquire a machine and do that I don’t know what are your thoughts on that I can tell you

20:51

I want to say it was approximately two months ago the DPW they had beta tested a machine that can clean the sidewalks

20:59

they didn’t take it on Court Street so I think if we were going to pursue that we probably would want to bring it down the

21:04

Court Street to see how well that would work certain areas of Court Street are very narrow so we want to make sure we

21:09

can use that and this machine actually did have a power washer on as well that we thought we could use to help clean up

21:15

some of the graffiti so that machine was approximately a hundred and ten thousand dollars but it’s something that we can

21:20

continue to pursue like I said bring it down here one more time and see if it would actually work on Court Street I mean we’re a tourist town do we have

21:27

apple funds available to it we do I have apple funds because that would be the

21:32

certain time manager had met with the finance director just last week tomorrow to go through the Opera funds the

21:38

intention is to bring a set of requests before the select board next Tuesday for

21:45

the use of someone’s Opera Furniture so this is a a good uh good timing on this request that’s right and it’s exactly

21:52

what Apple funds are fought to okay great thanks

22:01

anyone else in a new business letters

22:09

all business you want to take the motion to reconsider at this time

22:16

sure I’d make a motion to reconsider um the group motion that was made to

22:22

approve all the licenses permits and administrative notes as a group I voted in the affirmative

22:29

second to reconsider motion by Mr Canty second by Mr bletter

22:37

we need to do a vote on this right I am assuming Mr bletzer yes Mr Helm yes Mr

22:43

Canty yes Mr Mahoney yes myself yes

22:49

Mr Blaster you had a question yes and number two uh

22:54

the outside the outdoor dining uh

23:00

I saw I’m trying to find out where it is but

23:06

it’s a I’m concerned with the tables on the sidewalk in that space

23:17

there they have a patio already so I don’t really know what the need is to have

23:22

uh have that if if they’re going to do an apocalypse I could see but I don’t see first of all I don’t

23:29

think they have takeout pack and I don’t believe the pgtc allowed that for them so I I see tables on both sides of the

23:38

sidewalk and I I just don’t it’s going to be with staff working out there it’s going to be too congested I don’t think

23:45

it’ll be ADA Compliant and I don’t think it’s necessary they have that patio

23:50

already and I just think it’s it’s uh it’s not going to be ADA compliance it’s

23:57

going to be a problem that’s side work I know last year it was it was it was blocked off it was basically blocked off

24:04

you couldn’t even get through there so people are walking dogs they’re going right through where Foods being served

24:11

you know and so I just I don’t think it’s necessary so I’m not in favor of that

24:19

well I have to agree with Mr bletzer and I apologize for not picking up that this

24:25

was in the uh um the notes that we needed to work on because I I you know

24:31

my experience on the outdoor dining and you know and the reasons for moving to

24:38

the outdoor dining program that we have from the original outdoor dining that was very expedient during the the covet

24:45

during the very beginning of covet one of the areas that was problematic was

24:53

um Sam Diego’s and it was their use of the sidewalk space um it was problematic for the residents

25:01

and pedestrians um the way that it is set up here you

25:06

really can’t help but unless you’re eating there feel like

25:11

you’re walking through people’s burritos I mean really it really does feel like that and I mean I think if they’re

25:18

serious about wanting some sidewalk space they should come back with an adjusted drawing where it’s only on one

25:24

side and gives much more room and free flow through you know because this this

25:30

thing of tables on either side where people get to have to walk through the middle just doesn’t work

25:38

Anthony Mr chairman we have um someone by the name of James

25:43

um that would like to speak James you can unmute yourself

25:52

um [Music]

25:59

we were in front of me last week and I apologize

26:04

um it didn’t come up in our liquor license hearing but um the existing patio in the front of

26:12

the restaurant is more than adequate for for our needs so the parking spots were I think it was they were applied for

26:19

because that they had existing permission to use them but we don’t intend to use them

26:25

sidewalk the other sidewalk you don’t need it

26:32

okay James thank you very much and again I I as I said that last week I wish you

26:39

luck you’re gonna you get a great reputation down the cape and I hope you uh can keep going up here so uh I want

26:48

to welcome you thank you yeah and we’re looking forward to you bringing a crisp to Plymouth

26:54

I appreciate the kind of work we’re looking forward to it as well thank you

27:00

okay so I I have to ask this question are there any other restaurants down

27:05

there that are using the sidewalks or what’s the policy going forward I mean

27:12

so the board previously approved kkd’s back in February or March and their plan

27:18

did include outdoor dining spaces that were in the sidewalk so the board has

27:24

previously approved kkds for outdoor now if that’s something the board wants to change going forward like you just we’re

27:30

going to make tonight that was a decision you’re going to make we’d have to do that next year but but I think if you look at the

27:37

delineation of use of the sidewalk it’s one side it’s not like in this case

27:43

which they’re not going to do which is both sides so I don’t think it’s correct here yeah you’re not going to find any

27:49

restaurant that’s causing pedestrians to walk through the middle of people people’s meals so that was we were very

27:56

specific about that on the outdoor dining and it’s carried forward what happens next year is a whole other

28:03

matter um so in Mr Jim and in the meantime uh I

28:10

don’t know who’s job it is to to enforce but but I was

28:16

down there Sunday and there was a a couple of small tables with the same which was you know I’m not going to say

28:22

which business it was but it was it wasn’t I know that wasn’t ADA Compliant so I had no problem with the two little

28:29

tables but the sign was people couldn’t I mean if somebody’s in a wheelchair would have been tough getting through so

28:35

you know I think we got to be consistent on what we’re doing so I’m not sure who’s who’s tasked with that with that

28:43

assignments but I just I’m pro-business and I just want to say that the reason why I want

28:48

to make the sidewalks is inviting as possible is because we have to we’re responsible for all businesses not just

28:55

buys and restaurants which I want to help all the buyers and restaurants but there’s retail businesses that need

29:03

decide what business people come and walk in and looking in the stores and shop and so we got to make sure we keep

29:09

those sidewalks clear for all the businesses thank you

29:14

um agreed with all points made I think what would be helpful on our end um and maybe we do this after the summer

29:22

season all the apocalypse the approvals have been issued it sounds like all the

29:28

sidewalk dining approvals have been issued at this point but we have a

29:34

number of restaurants that are using the sidewalk for different purposes

29:39

some of them have tableside dining like San Diego’s did last year on the

29:44

sidewalk service at the table and then there’s other places that just use

29:49

tables and chairs for takeout and so and then we have the packlets so it would be

29:55

important for us to get to work with the board and get some clear guidance of what’s going to be the policy moving

30:01

forward are we going to allow for take tables and chairs for takeout

30:06

and not allow it for a table service dining so those are the

30:13

things I think when they have to work through for next summer

30:18

well I said it when we started with kovid and we went outside and we had the

30:24

outdoor dining that the day would come and to remind everybody it was because of covert that we had

30:30

dining in the street and dining on the sidewalks and so um you know we’ll take

30:36

it up for next year as a board but I you know I’m going to be pretty

30:42

well I want to be very honest I’m not going to support sidewalk dining when they have the opportunity to use

30:49

apocalypse I mean that’s you know in other words they want the free table but they don’t want to pay for the

30:55

pocket I mean I’ll call it like I see it that’s what I see and you know covet is

31:01

over at the moment or winding down so um that’s just me I think that go to

31:08

the apocalypse but we’ll we’ll put it on as a docket item and go over it when time comes I hope

31:14

Mr Helm uh Mr Cornell I would I would I’m in total agreement um with putting it on as a as a docket

31:21

item um as you know as the select board liaison and somebody helped create the

31:27

outdoor dining committee um I do feel it is time that the board

31:32

examine that you know it was it was created at a

31:39

time of need and expediency to blend the need and expediency with with an outdoor

31:46

dining concept that we could all be proud of so I think we are transitioning to something else to a different time so

31:53

I would be in total agreement and support of bringing that up as a discussion item to how to move forward

32:00

Mr chairman Mr bellezza one last thing for me on that is when I was out John

32:06

I’m going to give a history lesson like I’ve taken the edge out of your book when I was on the pgdc BG DC when this

32:15

first started we actually donated the packlets because it’s with with tasks

32:22

with those those are packing spaces that PG DC is responsible for and we sent the

32:28

letter that the second year when the packlets came to fruition Tatum

32:35

still it was really the big uh the big motivator for that and we had sent the

32:41

letter to the town manager at the time who was new Derek saying that we’re in full support of the

32:48

Apocalypse we don’t have a problem but we we were adamant about having no

32:54

tables on the sidewalk and the letter said that we we had talked to all the businesses the retail the that’s when

33:00

the two-way one-way stuff was going on too and so the pgd well the letter said

33:06

that with no problem giving packet spaces but we don’t want the sidewalks to be uh to be to to anything tables on

33:14

the sidewalks because because the businesses the retail businesses were not were not happy with that they wanted

33:20

the side Works to stay free and clear with no problem with the pocket spaces

33:25

so I I agree but what all as I’m saying is that there’s a third factor in this there’s tables and chairs that are on

33:32

the sidewalk that are that food establishments use for takeout and so that’s that’s the X Factor I

33:39

don’t think anybody’s ever talked about there’s a number of food extensions that have tables and chairs on the sidewalk

33:45

that people go in they grab a sandwich they grab a dessert and they go sit it on the on the side so as you said we

33:51

need a policy exactly so a question for you Derek um are those

33:57

restaurants also involved in the parklet outdoor dining concept they are not

34:02

that’s what I had a feeling so I know I know who you’re talking about

34:09

okay so I guess Derek if you could please um talk it out with Lisa and and see

34:15

what kind of time frame so we can take this up as a board have a docket item and give Lisa time so when the new

34:22

rental or whatever it is sure all right thank you good okay so we need

34:29

I can’t remember now if we voted on two again or not no we need a motion okay I

34:34

would make a motion uh that we approve the licenses permits and administrative notes one and three as one group

34:44

oh second motion by Mr Canty second by Mr bletza

34:49

discussion follows in favor Mr bletzer yes Mr Helm

34:54

yes Mr Canty yes Mr Mahoney yes in my in myself yes unanimous as far as number

35:03

two uh I would I would make a motion if

35:09

per the owner uh what he just said to us that we will

35:14

approve outdoor dining in his in his patios outside patio which I don’t even

35:21

think we have to approve it we don’t have to do that so uh so

35:28

so we don’t need emotion there’s no no just strike number two yeah strike

35:33

number two you know prayer the with the information the uh the uh Jim gave us the owner that he’s not going to use at

35:40

the sidewalks or parking spaces I think if I if I think we should make a motion and

35:46

then just vote against it yeah yeah but we should make the motion motions are made in the affirmative so

35:53

we should still make the motion to approve and then just vote against it

36:04

I’ve never been a chairman so go ahead I make a motion that we approve

36:10

administrative note too second motion by Mr Canty second by Mr Helm Mr bletter no

36:19

Mr Helm no Mr Canty no Mr Mahoney no and myself no

36:28

alrighty now do we have any more old business

36:36

okay I’d like to adjourn the Open Session and then we’re going to go into executive session

36:42

motion to adjourn second motion by Mr Plaza second by Mr

36:49

helm follows in favor Mr bletzer yes Mr Helm yes Mr Canty yes and Mr Mahoney

36:56

yes thank you for watching have a good week everyone we’ll see you next week
